What does is cost to appoint a process agent?
We offer two types of service. You can appoint Tremark Process Agents on an annual rolling agreement at £125 per year or you can opt for a non revocable fixed term agreement (this is sometimes required by lenders. A fixed agreement can also work our more cost effective. For example a 5 year fixed agreement is £480. This provides a saving of £145 over a 5 year period compared to an annual rolling agreement. I have never had to appoint a process agent before and am not really clear what I need to do! Can you help me?
Yes! We completely understand and can reduce your burden by providing clear, reliable advice and a professional service that meets your needs. How long does it take to establish a facility?
Our standard turnaround time is two to three working days, although many facilities are established faster than this. If you have an urgent need for a process agent, we offer a guaranteed same day service for an additional fee. Completed order forms need to be received before 2pm UK time. If it is after 2pm, please contact us. It may still be possible for us to return the documentation on the same day, depending on the complexity of the appointment. These situations will be decided on a case- by-case basis.
Will there be any other fees once the facility is established?
For a fixed term appointment, usually not. An annual facility is invoiced each year until cancellation. Apart from this, we would only charge additional fees if you requested additional services, such as an amendment to an existing facility or an extension to one which is expiring.
What documentation will I receive from you?
Once the facility is established, we will send you a signed confirmation letter, a countersigned version of the order form you provided (forming our contract with you), and our invoice.
Do you take payment by debit or credit card?
We accept payments via bank transfer or debit or credit card. Our bank details and a link for card payments will be provided to you once we have received you completed order form.
Do we receive a letter of appointment and is there an additional charge for this?
We will supply the appointor with our formal letter of appointment for no extra fee. (included within the service. Further letters of appointment can be supplied to additonal parties as a further cost of £50 per letter. Should a third party require their own worded letter of appointment providing on our letterhead or a separate letter countersigning, an additional fee of £50 will be charged. We will of course need to check the actual wording of the letter to ensure that it does not differ from our agreement with you.
Can we be invoiced and pay in our local currency rather the GBP/sterling?
We can invoice clients in various currencies, including USD, EUR, JPY, GBP, AUD, CAD, CHF, and CNY. Online and card payments accepted for your convenience.
What happens if you receive a legal notice?
We offer a very quick and efficient service. We will contact you as soon as the notice is received (usually within 1 day) to inform you that this is the case. You will then have the option of whether you would like the notice scanned and sent to you via email (most clients' preferred option), sent via Royal Mail or sent via a courier at an additional fee.
What types of 'Process' or 'Legal Papers' do you accept and agree to be served with?
We accept service of proceedings in the UK for notices, proceedings, or other documents issued from the courts of England and Wales, as well as for arbitration proceedings. We will protect against invalid service and carefully examine served papers and do not accept legal documents unrelated to the financial transaction in which we are named.
What is a UK process agent?
A UK process agent is an independent party appointed to receive legal notices and court documents on behalf of a company or individual, typically in connection with a contract governed by English law.
